About these terms

These terms apply to your use of emberandoakdesign.com (the "site"), run by Ember and Oak Web Design (Pty) Ltd, registration number 2025/166996/07, a company registered in South Africa ("Ember & Oak", "we", "us"), 9 Verbena villas, Jeffreys Bay, 6330. By using the site you agree to them. How we handle personal information is explained in our privacy policy.

Using the site

You’re welcome to browse, share and link to the site. Please don’t:

• use it in a way that breaks the law or harms anyone;
• try to get unauthorised access to it, disrupt it, or overload it;
• copy large parts of it automatically (scraping), or reuse our content as your own.

We work to keep the site available and accurate, but we may change, pause or remove parts of it at any time without notice.

Prices and information

Prices on the site are starting prices ("from"), shown in US dollars, pounds or euros and including VAT where it applies. They are a guide, not an offer: your actual price depends on your scope and is agreed with you in writing before any work starts. Project-based services are quoted to your scope.

Hiring-cost comparisons (for example on the Success Team page and in our CFO brief) use published salary and employment-cost data, with sources named. They’re estimates to help you compare options, not financial advice.

We keep the site accurate and up to date, but it’s general information about our services. Please check anything important with us before relying on it.

Working with us

Retainers and projects are covered by a separate written agreement (a proposal or contract) that sets out the scope, price, timeline, minimum term, refund terms and ownership of the work. If anything on the site differs from your agreement, the agreement wins.

Summaries on the site, such as the 30-day refund on retainers, the six-month minimum and your ownership of the work from day one, describe how our standard agreement works. The agreement contains the full terms.

Fit Calls

A Fit Call is free and there’s no obligation. Bookings are made through Cal.com, and you can reschedule or cancel using the link in your invite. We may decline or move a booking if needed, and we’ll let you know if we do. Anything we suggest on a call is an initial view, not a formal proposal.

Our content

The site’s design, text, graphics, logo and code belong to Ember & Oak or are used with permission. You may view, print and share pages for your own business purposes, including forwarding our CFO brief to colleagues. Please don’t reproduce or adapt our content for other purposes without asking us first.

Other companies’ names and sites

Client names, logos and websites in our case studies belong to their owners. Webflow, Shopify, Astro and other product names are trademarks of their owners; the Webflow Premium Partner badge is used under Webflow’s partner programme.

Links to other websites, including our clients’ sites and Cal.com, are for convenience. We don’t control those sites and aren’t responsible for their content or how they handle your information.

Liability

The site is provided "as is". As far as the law allows, we aren’t liable for any loss arising from using the site or relying on its information, including loss of profit, business or data, or indirect loss.

Nothing in these terms limits liability that can’t be limited by law, including rights you may have under South Africa’s Consumer Protection Act or the consumer laws of your country. Our liability for the services we provide is set out in your agreement with us.

Governing law

These terms are governed by the laws of the Republic of South Africa, and the South African courts have jurisdiction over any dispute about them. If you live in another country, you keep any consumer protections its law gives you.
